1. Introduction & Acceptance of Terms

Welcome to Adswaalaah ("Company", "we", "our", "us"). Adswaalaah is a user-driven digital advertising platform operating in India that enables registered users to earn monetary rewards by participating in advertising campaigns, specifically by posting promotional content on their WhatsApp Status and other designated social media platforms.

By accessing, registering, or using the Adswaalaah platform (the "Platform"), you signify your absolute and unconditional agreement to these Terms & Conditions. These terms constitute a legally binding electronic contract under the Information Technology Act, 2000, and applicable rules thereunder. If you do not agree with any part of these terms, you must immediately cease using our Platform.

2. Eligibility & Capacity to Contract

To utilize the services provided by Adswaalaah, you must be capable of forming a binding contract under the Indian Contract Act, 1872.

• Minors: While there is no strict minimum age to interact with our platform, users under the age of 18 (minors) must obtain explicit, verifiable consent from a parent or legal guardian. The parent or guardian assumes full legal responsibility for the minor's actions on the Platform.
• Residency: These services are primarily designed for users residing within the jurisdiction of India.

3. Nature of Services

Adswaalaah acts as an intermediary connecting advertisers with users. As a user, you voluntarily opt to complete specific advertising tasks provided on the Platform.

• Tasks: These generally involve downloading promotional media (images/videos) and posting them to your WhatsApp Status or other personal social media profiles for a specified duration.
• Independent Contractor: Your participation does not constitute an employer-employee relationship, partnership, or joint venture with Adswaalaah. You operate as an independent participant.

4. User Responsibilities & Obligations

Integrity and authenticity are the cornerstones of our platform. By participating, you legally bind yourself to the following standards of conduct:

• Strict Adherence to Instructions: You must complete each task precisely as outlined in the campaign details.
• Genuine Proof Submission: You are required to submit unedited, authentic screenshots or screen recordings as proof of task completion.
• Prohibition of Misuse: You shall not use automated scripts, bots, or modified applications to artificially inflate views or bypass platform protocols.

5. Task Approval & Reward Allocation

Rewards are never guaranteed merely upon submission of a task. The allocation of funds is subject to a strict verification process.

• Manual Verification: All submitted proofs are manually reviewed by Adswaalaah administrators.
• Admin Discretion: The administration holds absolute, unchallengeable discretion over the approval or rejection of any task based on internal quality metrics.
• Finality of Decisions: If a task is rejected due to low visibility, improper formatting, or violation of guidelines, the decision is final and non-negotiable.

6. Payments, Withdrawals & Taxation

Adswaalaah aims for seamless financial transactions, but operates within the realities of digital banking infrastructure.

• Payment Modes: Payouts are executed exclusively via Unified Payments Interface (UPI) or other legally recognized digital payment gateways in India.
• Processing Timelines: Standard withdrawal requests are processed within a window of instant execution up to 48 working hours.
• Banking Delays: Adswaalaah is not legally liable for delays caused by third-party payment processors, server downtimes at the National Payments Corporation of India (NPCI), or the user's respective banking institution.
• Tax Liability: Users are solely responsible for declaring and paying any applicable income taxes on their earnings as per the Income Tax Act, 1961.

7. Zero Tolerance Policy for Fraud & Misuse

Any attempt to defraud the platform, its advertisers, or other users constitutes a severe breach of this contract and potentially violates provisions of the IT Act, 2000.

• Fabricated Evidence: Uploading photoshopped, altered, or stolen screenshots.
• Multiple Accounts: Operating syndicates or multiple accounts by a single individual to farm rewards.
• Referral Abuse: Utilizing fake numbers or emulators to exploit the referral bonus system.

Consequences: Discovery of such activities will result in immediate and permanent account termination, forfeiture of all accumulated earnings (pending and processed), and potential legal action.

8. Account Suspension & Termination

Adswaalaah reserves the inherent right to suspend, disable, or permanently delete any user account at any time, for any reason, without prior notice. This right is typically exercised in cases of policy violation, erratic behavior, or risk to platform integrity. By using the platform, you waive the right to seek damages for account suspension.

9. Usage of Virtual Private Networks (VPNs)

While the use of a Virtual Private Network (VPN) for personal privacy is generally permitted, utilizing a VPN to mask malicious activities, bypass geographical task restrictions, or create fraudulent accounts is strictly prohibited. If our security systems detect abusive VPN routing, your account may face temporary holds or permanent bans.

10. Limitation of Liability & Indemnification

To the maximum extent permitted by Indian law, Adswaalaah, its founders, and affiliates shall not be held liable for any indirect, incidental, or consequential damages arising from your use of the platform.

• We do not guarantee uninterrupted platform access or uninterrupted supply of advertising tasks.
• We hold no liability for WhatsApp or other social media entities suspending your personal accounts due to the posting of promotional content.
• You agree to indemnify and hold harmless Adswaalaah from any claims, damages, or legal fees arising from your violation of third-party rights or breach of these terms.

11. Modification of Terms

The digital landscape is dynamic. Therefore, Adswaalaah reserves the sole right to amend, alter, or rewrite these Terms & Conditions at any time. Significant changes will be communicated via platform notifications, but it remains the user's responsibility to review this document periodically. Continued use post-modification implies legal acceptance of the revised terms.

12. Governing Law, Jurisdiction & Contact

These Terms shall be governed strictly by the laws of India. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the competent courts in India.
